Welcome to Brody Admissions, owned by Brody, LLC. Brody Admissions and its affiliates provide their services to you subject to the following conditions. If you visit or buy services at Brody Admissions or anyone affiliated with Brody Admissions, you accept these conditions. Please read them carefully. In addition, when you use any current or future Brody Admissions service or visit or purchase from any business affiliated with Brody Admissions, whether or not included in the Brody Admissions Web site, you also will be subject to the guidelines and conditions applicable to such service or business. This contract limits Brody, LLC’s liability.

Brody.com’s trademarks and trade dress may not be used in connection with any product or service that is not Brody, LLC’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Brody.com. All other trademarks not owned by Brody.com or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Brody.com or its subsidiaries.

Brody Admissions grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Brody Admissions or unless that page explicitly allows redistribution. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Brody Admissions. You may not use any meta tags or any other "hidden text" utilizing Brody Admissions’ name or trademarks without the express written consent of Brody Admissions. Any unauthorized use terminates the permission or license granted by Brody Admissions. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of Brody Admissions so long as the link does not portray Brody Admissions, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Brody Admissions logo or other proprietary graphic or trademark as part of the link without express written permission.

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Brody Admissions does sell products for people under age 18, but it sells them to adults, who can purchase them with a credit card. If you are under 18, you may use Brody Admissions only with involvement of a parent or guardian. Brody Admissions and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Visitors may post reviews, comments, essays, resumes, and other content; send other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." If you do post content or submit material including essays and resumes, you grant Brody Admissions and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to edit, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content subject to the Privacy Agreement. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Brody Admissions or its affiliates for all claims resulting from content you supply. Brody Admissions has the right but not the obligation to monitor and edit or remove any activity or content. Brody Admissions takes no responsibility and assumes no liability for any content or text posted or submitted by you or any third party.

Brody Admissions and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us.

Some items purchased Brody Admissions are sent through email. Brody Admissions will make every possible effort to deliver communications to you on time to your email address, but we cannot be responsible for technical difficulties related to the checking of your personal email account. We will make every effort to send your order to another email account specified by you if you encounter email difficulties.

Brody Admissions and its affiliates attempt to be as accurate as possible. However, Brody Admissions does not warrant that service descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Brody Admissions itself is not as described, your sole remedy is to contact Brody Admissions and allow us to try to satisfy your demands.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, BRODY ADMISSIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF 1)MERCHANTABILITY; 2) FITNESS FOR A PARTICULAR PURPOSE; 3) EFFORT TO ACHIEVE PURPOSE; 4) QUALITY; 5) ACCURACY; 6) NON-INFRINGEMENT; 7) QUIET ENJOYMENT; AND 8) TITLE . BRODY ADMISSIONS DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR E-MAIL SENT FROM BRODY ADMISSIONS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. BRODY ADMISSIONS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES EVEN IF BRODY, LLC. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS. EVEN IF THE LIMITATIONS SET FORTH IN THE PRECEDING PARAGRAPH ARE HELD INAPPLICABLE OR UNENFORCEABLE FOR ANY REASON, THEN BRODY ADMISSIONS’ MAXIMUM LIABILITY TO YOU FOR ANY TYPE OF DAMAGES SHALL BE LIMITED TO US$100.00.

In no event will Brody, LLC, its officers, directors, employees, editors, counselors, hired independent contractors, and/or representatives be held liable for any damages of any kind, including without limitation compensatory, direct, indirect, or consequential damages, loss of income or data, loss of or damage to property, and claims of customers or third parties arising from any customers' rejection from any undergraduate, graduate, or professional program or employment opportunity of any kind, or failure by any client to make any particular decision or select any particular course of action as a result of the advice of Brody, LLC or any of the aforementioned parties. You submit applications, essays, resumes, and other materials at your own risk. Further, clients and website users agree to hold Brody, LLC harmless from any academic, administrative, criminal, or civil proceedings. If a customer is rejected by college, graduate school, professional programs or potential employers, the customer has no legal recourse against Brody, LLC, EVEN IF BRODY, LLC WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR WAS GROSSLY NEGLIGENT.

By visiting Brody Admissions, you agree that the laws of the state of Illinois, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Brody Admissions or its affiliates.

Any dispute relating in any way to your visit to Brody Admissions or to products you purchase through Brody Admissions shall be submitted to confidential arbitration in Illinois in a court that is geographically closest to the main office of Brody Admissions in Chicago, IL except that, to the extent you have in any manner violated or threatened to violate Brody Admissions intellectual property rights, Brody Admissions may seek injunctive or other appropriate relief in any state or federal court, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Brody Admissions is committed to providing exceptional counseling at affordable prices; however, Brody Admissions is under no legal obligation to refund the purchase price of any service under any circumstance unless explicitly put forth by Brody Admissions. Brody Admissions will seek to satisfy every customer in a reasonable way through extended counselor interaction, etc. Brody Admissions also reserves the right to use its work in instructional or promotional material subject to the Privacy Agreement.

In no event will Brody, LLC, its officers, directors, employees, editors, counselors, hired independent contractors, and/or representatives be held liable for any damages of any kind, including without limitation compensatory, direct, indirect, or consequential damages, loss of income or data, loss of or damage to property, and claims of customers or third parties arising from any customers' rejection from any undergraduate, graduate, or professional program or employment opportunity of any kind. You submit essays, resumes, and other information and documents at your own risk. Further, clients agree to hold Brody, LLC harmless from any academic, administrative, criminal, or civil proceedings. If a customer is rejected by college, graduate school, professional programs or potential employers, the customer has no legal recourse against Brody, LLC.

If you do post or submit content (resumes, essays, etc.) or submit material, you grant Brody Admissions and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, edit, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content subject to the Privacy Agreement. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Brody Admissions or its affiliates for all claims resulting from content you supply. Brody Admissions has the right but not the obligation to monitor and edit or remove any activity or content. Brody Admissions takes no responsibility and assumes no liability for any content posted by you or any third party.
